Terms and Regulations of the Services Offered by Gitysoft Technologies

These supply conditions govern the contractual relationship between Gitysoft Technologies and the Customer for the provision of services described below.

Domain Transfer Policy & Conditions

1. Domain Transfer Restrictions

A newly registered or Renewd domain can only be transferred to another registrar after 60 days. For Gitysoft to Gitysoft transfers, a minimum of 10 days is required to avoid suspension.

General Service Terms

6. Offer Validity and Account Verification

Offers are valid only for new email accounts. Each Gmail account is considered valid for one user. Ensure to verify your email after creating an account.

7. Verification Requirements

You must provide valid government ID proof during verification. Always use accurate details such as name, email, phone number, and address when registering a domain.

8. Domain Spelling

Once a domain is booked, spelling changes are not permitted. Double-check your domain's spelling before confirmation.

9. Illegal Activities

Domains associated with spam, phishing, or other illegal activities may be suspended or terminated without prior notice.

10. Domain Booking Duration

Domains can be booked for a minimum of 1 year and a maximum of 10 years.

11. DNS Propagation Time

DNS propagation time is typically 0-48 hours. Contact our support if the DNS has not propagated within this timeframe.

12. EPP/Authentication Code Issues

If there are issues with obtaining the EPP or Authentication Code for domain transfer, contact our support team immediately.

13. Domain Transfer from Another Registrar

Domain transfer from another registrar takes 7 days. A full refund will only be provided if the order is canceled within 24 hours.

14. Hosting Plan Purchase

Review all features and resources before purchasing any hosting plan. If a plan includes a free domain and you cancel within 7 days, the domain cost will be deducted from the refund.

15. Content Violations

Hosting accounts containing spam, fake, or copyrighted content will be suspended without notice. Refunds will not be provided in such cases.

16. Backup Responsibility

It is your responsibility to back up data regularly unless your hosting plan includes auto-backup. Gitysoft is not responsible for data loss due to server crashes.

17. Domain Renewal Notifications

You will receive 1-2 emails for domain renewal reminders. Ensure timely renewal to avoid additional redemption fees.

18. Digital Service Shipping/Delivery

Digital services like domain registration and hosting plans are delivered electronically after payment confirmation. Ensure your email address is correct to receive service details promptly.

19. Modification of Terms

Gitysoft reserves the right to modify these terms at any time, and such changes will take effect upon posting on this website.

20. Governing Law and Disputes

These terms are governed by the laws of India, and any disputes shall be resolved in the courts of Delhi.

Additional Service Terms

21. Support for VPS or Dedicated Servers

In case of VPS or Dedicated Servers with root access, we will solve your queries and provide support only when you provide us the login details.

22. Excessive Space and Bandwidth Utilization

Gitysoft Technologies expressly reserves the right to review every Account for excessive space and bandwidth utilization, and to terminate or apply additional fees to those Accounts that exceed allowed levels.

23. No Spam Policy

Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming") is prohibited. Spamming negatively impacts consumer attitudes and can overload our network, disrupting service. Refunds will not be provided in such cases.
All clients must implement CAPTCHA, such as Google's Captcha, to prevent spam and malicious emails via website contact forms. Websites using PHP forms without CAPTCHA will be taken down. If a party does not have a PHP developer, we recommend not using contact forms until CAPTCHA is implemented.

24. Service Level Agreement

Gitysoft Technologies guarantees 99% Service Availability. In case of failure to meet the service guarantee, you may receive Service Credits based on the monthly service charge. Exceptions include:

25. Retention & Backup Policy

Server logs are retained for at least one month. While we strive to maintain backups, Gitysoft Technologies cannot guarantee backup availability at all times. You, as the user, are responsible for maintaining your own backups. Gitysoft Technologies is not responsible for any loss of data.

26. Trademark and/or Copyright Claims

Gitysoft Technologies supports intellectual property protection. Customers must ensure that their services do not infringe upon others' intellectual property rights or publish illegal content. In case of DMCA notices, Gitysoft Technologies reserves the right to remove content without notice.

Additional Usage and Abuse Policies

27. Service Renewal and Data Availability

Your account and data will not be available if you fail to renew the service on time. Data will be automatically deleted after 15 days from the overdue date.

If you fail to renew your hosting plan on time, and you request to recover or unsuspend your data later, you will be required to pay the full hosting charges equivalent to the annual plan amount. Without making this payment, data recovery, migration, or transfer services will not be provided under any circumstances.

28. Domain Availability

Domain registration is subject to the availability of the domain name at the time of registration.

29. Responsibility During Domain Transfers

Gitysoft is not responsible for the failure of a domain or website transfer from other service providers. Transfers may fail due to reasons like an incorrect EPP code, domain lock by another provider, or other technical issues. It is the user’s responsibility to ensure a successful transfer or renewal with the current provider.

30. Dedicated Server Environment

Gitysoft provides dedicated servers based on virtualized environments such as VMWare or KVM to ensure quality service and better uptime.

31. Inode Limit

The total number of inodes (files and directories) allowed is based on the hosting plan you choose and pay for.

32. Legal Compliance and Content Security

You are responsible for complying with all applicable laws and for the security of your content, files, and any data stored on your hosting account. You must also maintain regular backups and remove malware or malicious files immediately.

33. Data Theft and Intrusion

Accessing or stealing files, databases, emails, or backups from another customer's account is a serious violation. Gitysoft is not liable for such activities and will take strict action if detected.

34. Malware Suspension and Reactivation

If your server is suspended due to malware, phishing, or prohibited content, a re-activation fee of Rs. 5000 INR will be charged. No rebates will be provided.

35. Cron Job Limits

Violation of these limits may result in investigation, suspension, or questioning of your cPanel account.

36. Resource Consumption Limits

Any cPanel account must not:

High CPU or RAM usage beyond these limits is considered abuse and may lead to suspension.
